Waste Removal Enfield Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Enfield provides waste collection and related services to residential and commercial customers. By booking a waste removal service, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions:

Company means Waste Removal Enfield, the waste collection service provider.

Customer means the person or business requesting and paying for the services.

Services means waste removal, waste collection, clearance, loading, transportation, and disposal services supplied by the Company.

Site means the address or location where the Services are to be carried out.

Waste means the materials, items, rubbish and refuse to be collected and removed as part of the Services, excluding any prohibited items.

2. Scope of Services

The Company provides waste collection and removal services, including but not limited to household rubbish clearance, bulky waste removal, commercial waste collection, garden waste removal, and general non-hazardous waste services, subject to these Terms and Conditions and applicable waste regulations.

The Company will carry out the Services with reasonable care and skill, using appropriate vehicles, equipment and staff to collect, load, transport and dispose of Waste at authorised facilities in compliance with relevant regulations.

3. Booking Process

3.1 Bookings may be requested by telephone, email, online enquiry, or any other method offered by the Company. A booking is only accepted once the Company confirms the details of the Service, the quoted price, and a collection date and time window.

3.2 The Customer must provide accurate information when booking, including the type and approximate volume or weight of Waste, the location of the Waste on the Site, access details, parking arrangements, and any other relevant information that may affect the Service.

3.3 The Company may request photographs or descriptions of the Waste and Site to provide an accurate quotation. Any quotation is based on the information provided and is subject to adjustment if the actual Waste or Site conditions differ materially from those described.

3.4 The Customer must ensure they have authority to request the Services at the Site, and that access is available on the agreed date and time. If access is restricted or unsafe, the Company may cancel or amend the booking and apply charges as set out in these Terms.

4. Quotations and Pricing

4.1 Prices are normally quoted based on volume, weight, type of Waste, labour required, access difficulty, and distance. All quotations are exclusive of VAT unless expressly stated otherwise, and VAT will be added at the applicable rate.

4.2 Quotations are estimates only and are subject to change on arrival if the actual Waste differs from that described, if the volume or weight is higher, or if additional labour or time is required due to access or Site conditions.

4.3 The Company will inform the Customer of any price adjustment before commencing work. If the Customer does not agree to the revised price, the Company may refuse to provide the Services and may charge a call-out or cancellation fee to cover costs incurred.

5. Payments and Invoicing

5.1 Payment is due in full on completion of the Service, unless agreed otherwise in writing in advance. The Company may require payment in advance or a deposit at the time of booking.

5.2 Payment methods accepted may include cash, debit card, credit card, bank transfer, or other methods offered by the Company. Where payment is made by card, the Customer authorises the Company to charge the agreed amount.

5.3 Commercial Customers may be offered invoicing terms at the Companys discretion. In such cases, payment must be made within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

5.4 If the Customer fails to pay any amount due, the Company reserves the right to charge interest on overdue sums at the statutory rate, to recover reasonable debt recovery costs, and to suspend or cancel further Services.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting the Company as soon as possible. Cancellations or changes are only effective once confirmed by the Company.

6.2 If the Customer cancels with at least 24 hours notice before the agreed collection time, no cancellation fee will usually be charged, unless otherwise agreed in advance.

6.3 If the Customer cancels within 24 hours of the agreed time, or fails to provide access to the Site at the agreed time, or the Waste is not available for collection, the Company may charge a reasonable cancellation or call-out fee to cover costs incurred, including travel and staff time.

6.4 The Company reserves the right to cancel or reschedule a booking due to vehicle breakdown, staff shortages, severe weather, access issues, safety concerns, or other circumstances beyond its reasonable control. In such cases, the Company will seek to notify the Customer and arrange an alternative time. The Company shall not be liable for any loss arising from such cancellation or delay, other than a refund of any pre-paid amount for the Service not provided.

7. Customer Responsibilities

7.1 The Customer is responsible for:

a. Providing accurate information about the Waste and Site.

b. Ensuring safe and reasonable access for vehicles and staff to the Site.

c. Obtaining any necessary permits for parking or access where required.

d. Ensuring that Waste is clearly identifiable and available for collection.

e. Separating prohibited or hazardous materials from general Waste.

7.2 The Customer must not knowingly include hazardous or prohibited waste in the collection unless expressly agreed in writing and in compliance with all regulations. Prohibited items may include, but are not limited to, asbestos, clinical waste, certain chemicals, solvents, gas cylinders, and certain electrical items.

7.3 If the Company discovers prohibited items mixed with the Waste, it may refuse to collect them, adjust the price, or apply additional handling and disposal charges. The Company may also suspend or terminate the Service where regulations have been breached.

8. Performance of Services

8.1 The Company will use reasonable efforts to arrive at the Site within the agreed time window. However, times are estimates only and are not guaranteed. Factors such as traffic, weather, or earlier jobs taking longer than expected may affect arrival times.

8.2 On arrival, staff will assess the Waste and access conditions. If the situation differs significantly from that described at the time of booking, the Company may revise the quotation before starting work.

8.3 Staff will load the Waste into the vehicle, taking reasonable care to avoid damage. The Customer must ensure that any fragile items, fixtures, or fittings not intended for removal are clearly identified and kept separate from the Waste.

8.4 Once the Waste has been collected and loaded, it becomes the property of the Company and will be transported for treatment, recycling or disposal at authorised facilities in accordance with applicable waste legislation.

9. Waste Regulations and Compliance

9.1 The Company operates in compliance with applicable UK waste management and environmental regulations and will only dispose of Waste at licensed or authorised facilities.

9.2 Where required, the Company will issue appropriate documentation such as waste transfer notes to evidence lawful transfer and disposal of Waste.

9.3 The Customer warrants that the Waste to be collected is not hazardous or controlled waste, unless the Company has expressly agreed in writing to handle such materials and all regulatory requirements have been addressed.

9.4 The Customer is responsible for any breach of regulations arising from inaccurate description or misclassification of Waste provided to the Company. The Customer shall indemnify the Company for any losses, fines, or penalties incurred as a result of such misdescription.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

10.2 Subject to the above, the Company shall not be liable for any indirect or consequential loss, including loss of profit, business, revenue, or goodwill arising out of or in connection with the Services.

10.3 The Companys total liability in respect of any claim arising from the provision of Services shall, to the fullest extent permitted by law, be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.4 The Customer must notify the Company as soon as reasonably practicable of any damage or issue alleged to have been caused by the Companys staff or vehicles. The Customer must give the Company a reasonable opportunity to inspect the damage and, where appropriate, to arrange repair or replacement.

10.5 The Company will not be liable for any damage to surfaces, driveways, access routes, or property where the Customer has requested or permitted the Companys vehicles or staff to operate in areas not suitable for such use.

11. Refusal of Service

11.1 The Company reserves the right to refuse to carry out all or part of the Services if:

a. The Waste includes prohibited or hazardous items not previously disclosed.

b. Access to the Site is unsafe, unlawful, or significantly restricted.

c. The Customer behaves in an abusive, threatening, or inappropriate manner.

d. Proceeding with the Service would, in the Companys reasonable opinion, breach any law, regulation, or licence condition.

11.2 If Service is refused for reasons attributable to the Customer, the Company may charge a reasonable call-out or cancellation fee.

12. Data Protection and Privacy

12.1 The Company will collect and process personal data, such as contact details and payment information, only for the purposes of managing bookings, providing Services, handling payments, and meeting legal or regulatory obligations.

12.2 The Company will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary for service delivery, legal compliance, or debt recovery.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Service, they should contact the Company as soon as possible, providing details of the issue and any supporting information.

13.2 The Company will investigate complaints in a fair and timely manner and will seek to resolve them through repair, re-service, partial refund, or other appropriate remedy, depending on the circumstances.

14. Changes to Terms and Conditions

14.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, regulations, or business practice.

14.2 The version of the Terms and Conditions in force at the time of booking will apply to that specific Service. The latest version will be made available on request.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Removal Enfield.
